The terms “we,” “us,” and “our” refer to Cloudy Prints. Cloudy Prints operates this store and website, including all related information, content, features, tools, products, and services (the “Services”) to provide you, the customer, with a curated shopping experience. Cloudy Prints is powered by Shopify, which enables us to provide the Services to you.
The following terms, together with any policies referenced herein (these “Terms of Service” or “Terms”), describe your rights and responsibilities when you use our Services. By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use or access our Services.
1. Access and Account
By agreeing to these Terms, you confirm that you are at least the age of majority in your jurisdiction and that you consent to allow any minor dependents to use the Services on devices you own or manage.
You may be asked to provide certain information to use the Services, such as email, billing, payment, and shipping information. You represent that all information you provide is accurate, current, and complete.

2. Our Products
We aim to provide accurate representations of our products and services. However, colours, appearance, and finishes may differ depending on your device or screen settings.
All descriptions are subject to change at any time, and we reserve the right to discontinue any product at any time or limit quantities.
Custom/Personalised Artwork
Custom or personalised illustrations are created in Cloudy Prints’ artistic style. Artistic interpretation is subjective. Minor revisions may be offered at our discretion, but requests for major changes differing from the original brief or approved draft may incur additional fees.
3. Orders
By placing an order, you make an offer to purchase. Orders are not accepted until Cloudy Prints confirms acceptance and payment is processed.
Cancellation & Refunds: Due to the personalised nature of custom artwork, orders cannot be cancelled, refunded, or exchanged once work has commenced, except where required under the Consumer Guarantees Act 1993 (NZ).
You represent that purchases are for personal use, not commercial resale or export.
4. Prices and Billing
Prices, discounts, and promotions are subject to change. The price charged is the price at the time of order, and does not include taxes, shipping, or import charges unless stated.
You agree to provide current, complete, and accurate payment information, and to pay all charges incurred.
5. Shipping and Delivery
Delivery times are estimates only and are not guaranteed. Cloudy Prints is not responsible for delays caused by carriers, customs, or events outside our control. Title and risk pass to you once products are transferred to the carrier.
6. Intellectual Property
All Services, including trademarks, brands, text, displays, images, graphics, video, audio, and website design, are the property of Cloudy Prints, its affiliates, or licensors.
You may use the Services for personal, non-commercial use only. You must not reproduce, distribute, modify, publicly display, republish, download, store, or transmit any material without written consent.
Copyright & Use of Artwork
All artwork, illustrations, designs, prints, and digital files remain the intellectual property and copyright of Cloudy Prints, unless otherwise agreed in writing.
Purchasing a product does not transfer copyright. Customers are granted a limited, non-exclusive licence for personal use only. Artwork may not be copied, scanned, traced, resold, redistributed, altered, or used commercially without written consent. This includes merchandise, tattoos, logos, websites, social media templates, or derivative works.
Customer-Provided Materials
By submitting photos or reference images, you confirm that you have the rights to them and grant Cloudy Prints permission to use them solely for creating your artwork.
Unless requested otherwise, Cloudy Prints may display completed artwork for portfolio, website, or social media purposes.
7. Optional Tools
Any optional third-party tools provided are offered “as is.” We do not monitor or control these tools and are not liable for their use.
8. Third-Party Links
Our Services may contain links to third-party websites. We are not responsible for their content or transactions. Please review third-party policies before engaging.
9. Relationship with Shopify
Cloudy Prints is powered by Shopify. All sales and purchases are made directly with Cloudy Prints. Shopify is not responsible for any aspect of your transactions.
10. Privacy Policy
All personal information is subject to our Privacy Policy. Shopify may also process personal information as part of hosting the Services.
11. Feedback
By submitting feedback, you grant Cloudy Prints a perpetual, worldwide, royalty-free licence to use it. Feedback must not violate third-party rights or contain harmful content.
12. Errors, Inaccuracies, and Omissions
We reserve the right to correct errors or omissions in product descriptions, pricing, shipping, or promotions, including after orders are submitted.
13. Prohibited Uses
You may not use the Services for unlawful, abusive, or harmful purposes, including IP infringement, spam, viruses, or interference with the Services.

We may terminate or suspend access to the Services at any time without notice. Certain sections survive termination, including Intellectual Property, Feedback, Disclaimer, and Governing Law.

18. Consumer Guarantees (NZ)
Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 (NZ), except as allowed by law. The CGA does not apply to business-to-business transactions.
19. Governing Law
These Terms are governed by the laws of New Zealand, and you submit to the non-exclusive jurisdiction of the courts of New Zealand.

We may update these Terms by posting changes on the website. Continued use of the Services constitutes acceptance of changes.
